Intellectual Property Policy

Effective Date: July 29th, 2024

At Quicky Stores, we value creativity and originality. Protecting intellectual property rights is central to maintaining trust and integrity in our marketplace. This policy outlines how we handle infringement claims, how intellectual property owners can report violations, and how sellers can respond if their listings or shops are affected.

This policy is part of our Terms of Use. By using Quicky Stores, you agree to comply with this policy.

1. Quicky Stores’ Role

Quicky Stores operates as a marketplace platform where independent sellers manage their own shops. Sellers are responsible for:

  • Listing their content, including images, descriptions, and products.
  • Ensuring they have the rights to the content they upload.
  • Complying with laws regarding intellectual property.

Quicky Stores does not create, manufacture, or ship products. Instead, we act as a platform for connecting buyers and sellers.

We reserve the right to:

  • Disable listings, shops, or accounts that violate this policy or our Terms of Use.
  • Take enforcement actions against policy violations or abuses of the Intellectual Property Policy.

Quicky Stores cannot provide legal advice or make legal determinations about infringement claims. We rely on reports of infringement from intellectual property owners and act on valid notices.

2. Reporting Intellectual Property Infringement

We aim to respond promptly to infringement reports and may remove or disable access to content based on valid claims.

When content is removed, we:

  • Notify the affected seller about the removal.
  • Provide details of the report, including the name and email address of the reporting party.
  • Offer guidance for submitting a counter notice in cases of copyright infringement.

How to File a Report

To submit a report of infringement, authorized parties may:

  1. Use the Quicky Stores Reporting Portal for faster processing.
  2. Complete our Reporting Form for cases involving usernames, shop names, or videos.
  3. Submit a DMCA notice in accordance with our Designated Agent requirements.

We may request:

  • Proof of ownership or authorization documents.
  • Identity verification of the reporting party.

We reserve the right to reject false, incomplete, or bad-faith reports and take action against policy abuse.

3. Counter Notices

For copyright infringement claims under the DMCA, sellers may file a counter notice if they believe the removal was inaccurate.

Steps for filing a counter notice:

  1. Submit a counter notice with required information.
  2. We will forward the notice to the complaining party.
  3. If no court order is filed within 10 business days, content may be restored.

Learn more about DMCA counter notices and filing requirements in our Help Center.

4. Repeat Infringement Policy

Quicky Stores enforces a repeat infringement policy by:

  • Terminating accounts involved in multiple or repeat violations.
  • Blocking attempts to reopen shops after termination.
  • Applying actions to related accounts operated by the same user.

Account privileges may be revoked at any time, at our discretion, and without notice if violations persist.

5. Withdrawing Reports

Only the intellectual property owner or their authorized representative can withdraw a report.

The withdrawal must:

  • Clearly identify the affected content (e.g., listing URLs).
  • State that it is a formal withdrawal.

Once verified, Quicky Stores will:

  • Notify the reporting party of receipt.
  • Inform the affected seller about the withdrawal.

Note: Withdrawals are handled on a case-by-case basis and do not guarantee account or shop reinstatement.
